These Terms and Conditions govern the use of services provided by SmartNetic Pty Ltd ("SmartNetic", "we", "us", or "our"). By accessing our website or using our services you agree to these terms.

SmartNetic provides services including but not limited to:

• Website hosting and maintenance
• Software development
• IoT device solutions
• Business automation systems

The specific scope of services will be agreed upon between SmartNetic and the client before work begins.


3. Payments

All services must be paid for according to the agreed pricing model.

Subscription services are billed monthly in advance.
Failure to pay invoices may result in suspension or termination of services.


4. Website Ownership

Unless otherwise agreed in writing:

Websites created under subscription packages remain the intellectual property of SmartNetic.

Clients are granted the right to use the website while their subscription remains active and in good standing.

Website files, code, design assets and infrastructure are not automatically transferred to clients upon cancellation.


5. Domain Names

Domain names registered on behalf of clients remain the property of the client unless otherwise agreed.

SmartNetic may manage DNS and domain configuration where required to operate services.


6. Client Responsibilities

Clients must ensure that any content provided:

• does not violate copyright
• does not break any laws
• does not contain harmful material

SmartNetic reserves the right to remove unlawful content.


7. Service Availability

SmartNetic aims to maintain reliable services but cannot guarantee uninterrupted availability.


8. Limitation of Liability

SmartNetic shall not be liable for indirect damages including:

• loss of revenue
• loss of profits
• business interruption
• data loss


9. Third‑Party Services

Services may depend on third‑party infrastructure such as hosting providers and domain registrars.

SmartNetic is not responsible for failures caused by those providers.


10. Termination

SmartNetic may terminate services if:

• a client breaches these terms
• invoices remain unpaid
• services are used for illegal purposes


11. Changes to Terms

SmartNetic may update these terms from time to time.


12. Governing Law

These Terms and Conditions are governed by the laws of South Africa.
